May 2008 has seen the introduuction of new traffic laws and the DGT – Traffic department - has introduced important changes. The approval of the reformed Código Penal – Penal Code - and its enforcement establishes that driving without having passed the relevant driving test as a serious offence, offenders can be punished with either prison sentences or community work.
The reform of the Código Penal concerning drivers has been in force since 1st May. These reforms were approved some time ago and which are already part of daily life state that it is a serious offence to drive without the corresponding licence or permit. The DGThas contacted around 25 000 offenders who were caught without a licence last year.
Article 384 of the Código Penal includes longer prison sentences - from 3 to 6 months or fines of between 12 to 24 months and community work of periods between 31 to 90 days - for all those on the road network without the correct licence or permit. Moreover other drivers are included in this group of offenders, those who have had their licence confiscated after losing all the points on their licence but are found behind the wheel of a vehicle.
Without a doubt the most worrying piece of data is that in the first few days of May, when the new laws came into force, police officers - Agrupación de Tráfico de la Guardia Civil – discovered 128 drivers without a licence on Spanish roads in just the first three days these “drivers” are now waiting for their case to be heard.
