Agreements with the European Commission
Repsol YPF (through its affiliate Repsol Comercial de Productos Petrolíferos S.A), promised the European Commission to respect the agreements described in matter COMP/B-1/38348 - Repsol C.P.P., in order to help competition in the Spanish service stations market.
The implementation of these agreements will allow a large number of service stations to choose their suppliers and ends the procedures relating to exclusive supply agreements.
The most significant promises made by Repsol YPF are:
- To respect the regulations of Rule 2790/1999 and, specifically, those having to do with anti-competition and sale price establishment clauses. (Exemption due to Rule category is not directly applicable to Repsol contracts, as long as they maintain a quota of over 30%)
- To increase the yearly number of service stations capable of changing supplier, allowing for the advance recovery of contracts in stations with ususfruct and surface rights.
- To not acquire, until 31 December 2007, any new service stations that are not currently supplied by Repsol YPF.
- To not make any new long term agreements.
- Publicise the expiration of contracts, on the Industry Ministry's website or on Repsol YPF's website.
